Czech Health Research Council (hereinafter referred to as "AZV") was established in 2014 by the Ministry of Health to support applied research in health care. The current eligibility rules for the competition valid until 2030 are summarised in the tender documentation and the programme (in Czech only).
Since the obligation to publish in Open Access (OA) mode is not legally required at this time, the AZV only recommends publishing in OA. However, if the results are published in OA mode, publication and similar costs such as Article Processing Charges ("APC") can be eligible for special purpose support.

The obligation to create an overview of research data management and information on the availability and dissemination of research results and research data is enshrined in an amendment to Act No. 130/2002 Coll. (Act on Support for Research and Development) from 2022. In the governing Programme itself, AZV then commits itself to comply with the FAIR principles.
For this reason,it is mandatory to prepare a research data management plan (hereinafter referred to as "DMP") for all projects funded by the AZV. Furthermore, it is also recommended in the FAIR principle and the word of the law to share the underlying research data itself in an appropriate form.
AZV provides financial support for the costs of creating the DMP and similar costs of managing the research data (anonymisation, processing, storage...). In addition, the costs of a Data Steward, i.e. a data management expert or similar professional positions, are also eligible to be covered to the extent necessary for the project (coordination, creation and management of research data).
The DMP is a document that specifies what data will be generated during the research and how it will be generated, and includes information on its availability and potential uses. The DMP needs to be updated regularly to reflect what has actually happened to the data.

At a minimum, the DMP should include:
what data will be generated, processed or collected
what methods and principles of data management will be used with respect to FAIR principles (findability, accessibility, interoperability and reusability)
how the data will be shared and published
how the data will be stored during and retained after the end of the project
AZV recommends following the FAIR principles when sharing data. These are based on the principle of "as open as possible, as closed as necessary", i.e. as open as possible, but closed as necessary. Becaude of this, the obligation to make research data available according to the AZV does not apply in several cases:
research data protected under laws governing the protection of the results of copyright, invention or similar creative activity, i.e. intellectual property rights
trade secret protection rights or other legitimate interests of the co/recipient (e.g. commercial exploitation)
data concernning national security
data which when published would be a disproportionate interference with the right to the protection of privacy and personal data
refusal to provide research data under Act No. 130/2002 Coll. if the research or development has not been fully financed from public funds (unless the researcher is obliged to provide information under Act No. 106/1999 Coll. and Act No. 123/1998 Coll.)
